This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Heard Mr. S.K. Padhi, learned Senior Advocate and Mr. M.S. Rizvi, learned Addl. Standing Counsel for the Vigilance Department.

Mr. S.K. Padhi, learned Senior Advocate appearing for the petitioner submitted that the petitioner Soubhagyalaxmi Tripathy has already appeared before the Investigating Officer twice and the Investigating Officer has told her that as and when required, she would be noticed for the purpose of interrogation.

Mr. Rizvi, learned Addl. Standing Counsel for the Vigilance Department produced a written instruction dated 01.10.2021 received from the Inspector Vigilance, Balasore

// 2 // Division, Balasore from which it appears that the custodial interrogation of the petitioner need not be required as the petitioner could not be able to defy the documentary evidences. The written instruction is taken on record. Learned counsel for the Vigilance Department submitted that the matter may be taken up after ensuing Summer Vacation in order to obtain instruction as to whether the petitioner has appeared before the Investigating Officer and cooperated with the investigation or not.

List this matter in the week commencing from 27.06.2022.

The interim order dated 02.06.2021 is extended till the next date.

If any document is required by the Investigating Officer and notice is issued to the petitioner to produce the same, she shall produce it if is available with her and if not, the same shall be intimated to the Investigating Officer in writing. Issue urgent certified copy as per Rules.
