1. Heard Mr. K. Mohanty, learned counsel for the Petitioner as well as Miss S. Mishra, learned A.S.C. for the State-Opposite Party.
2. The impugned order of cognizance dated 3.11.2012 and the subsequent order of issuance of NBW and process under Sections 82/83 of the Cr.P.C. are subject matter of challenge in the present petition.
3. The Petitioner is one of the accused relating to offences under Sections 294/307/120(B)/34, I.P.C. and Secs.25/27 of the Arms Act.
4. Upon hearing both the parties and perusal of the order-sheet of the trial court, I do not find any merit in the challenge of the Petitioner.
5. Accordingly, the CRLMC is dismissed.
6. However, as prayed by the Petitioner, it is open for him to surrender before the concerned court and seek for bail. ( B.P. Routray) Judge B.K. Barik
