This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioners and learned counsel for the State so also the learned counsel for the informant.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Fategarh P.S. Case No.50 of 2021 corresponding to G.R. Case No.45 of 2021 pending in the court of learned J.M.F.C., Bhapur for alleged commission of offences under sections 294/324/ 307/34 of the Indian Penal Code.

// 2 // Learned counsel for the State has produced the case diary and on verification of the same submitted that there are two injured persons in this case, namely, Basant Dhal so also Jilu Dhal and both of them have sustained simple injuries.

Considering the nature of accusation against the petitioners and submission that the ingredients of the offence under section 307 of the Indian Penal Code are not attracted and the fact that the petitioners have been granted interim protection as per the order dated 12.04.2021 and there is no material that they have misutilized the terms and conditions of the interim order, the interim order dated 12.04.2021 is made absolute The ABLAPL stands disposed of.
