This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioners and learned counsel for the State.
This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Dhusuri P.S. Case No.47 of 2021 corresponding to G.R. Case No.120 of 2021 pending in
// 2 // the court of learned J.M.F.C., Dhamnagar for alleged commission of offences under sections 341/323/325/ 506/34 of the Indian Penal Code.
Learned counsel for the State has produced the case diary and on verification of the same submitted that one Manas Barik is the injured in this case who has sustained simple injuries and there is no criminal antecedent against the petitioners.
Considering the submission made by the learned counsel for the petitioners that it is a case and counter, there is a background of civil dispute between the parties and the offences are triable by Magistrate and the petitioners have been granted interim protection as per the order dated 12.04.2021 and there are no materials that they have misutilized the terms and conditions of the interim order, the interim order dated 12.04.2021 is made absolute. Accordingly, the ABLAPL stands disposed of.
