This Court records the submission of learned counsel appearing for the petitioner that there has already been framing of issues and that there is no stay order operating against further proceeding of the C.S.No.164 of 2012, a proceeding transferred from the file of Civil Judge (Senior Division), Dharamgarh to the file of Civil Judge (Junior Division), Dharamgarh, this Court directs in the event there is no obstruction in proceeding the suit, there should be attempt by the Civil Judge, (Junior Division), Dharamgarh to conclude the suit proceeding at least within a period of one year. Plaintiff is debarred either from taking unnecessary adjournments or moving any Miscellaneous Application hereafter.

The Civil Miscellaneous Petition stands disposed of with the observation and direction made hereinabove.
