This matter is taken up through Hybrid Arrangement (Video Conferencing/Physical Mode). Heard learned counsel for the petitioners and learned counsel for the State.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioners in connection with G.R. Case No.252 of 2021 arising out of Kakatpur P.S. Case No. 66 of 2021 pending in the Court of learned J.M.F.C., Nimpara for alleged commission of offences under sections 341/323/324/ 506/294/325/326/34 of the Indian Penal Code.

// 2 // Considering the submission made by the learned counsel for the petitioners that there is existence of a civil dispute between the parties and petitioner nos. 1 and 3 are ladies, keeping in view the proviso to section 437(1) of Cr.P.C. and petitioner no.2 is an aged person and the injuries sustained by the two injured persons are simple in nature and after hearing the learned counsel for the State and the fact that the petitioners have been granted interim protection as per the order dated 12.04.2021 and there are no materials that they have misutilized the terms and conditions of the interim order, the interim order dated 12.04.2021 is made absolute.

Accordingly, the ABLAPL stands disposed of.

Issue urgent certified copy as per Rues.
