Heard learned counsel for the petitioner and learned counsel for the State.

Instant petition under Section 482 Cr.P.C. has been filed by the petitioner praying for quashing of the order of NBW dated 4th September, 2015 passed by the leaned Addl. Sessions Judge, Bhubaneswar in T.R. Case No.38 of 2014 on the grounds stated thereon.

Learned counsel for the petitioner submits that petitioner has been forwarded in connection with Energy P.S., Bhubaneswar Case No.51 of 2013 under Section 135 of the Electricity Act, 2003 but thereafter NBW was issued against the petitioner by the learned court below on 4th September, 2019 due to default. 4.
Perused the copy of the impugned order at Annexure-1, whereby learned court below issued the order of NBW against the petitioner due to his default which is absolutely justified and therefore, calls for no interference. However, learned counsel for
// 2 // the petitioner submits that the petitioner was on bail but due to default, the order has been passed.

Having regard to the above submissions of learned counsel for the parties, the Court is inclined to direct the petitioner to surrender and move for bail. Accordingly, it is ordered. 6.
The petitioner is directed to surrender before the court below on 26th September, 2022 in T.R. Case No.38 of 2014 and move for bail and in such an event, he shall be released on bail with conditions as deem fit and proper by the court below. 7.
The CRLMC application stands disposed of.
