Heard learned counsel for the parties.

The Petitioner is an accused in connection with G.R. Case No. 2 of 2022 arising out of Chandahandi P.S. Case No. 2 of 2022 pending on the file of learned JMFC, Chandahandi registered for the alleged commission of offence under Sections 302/ 34 of the I.P.C.

Being aggrieved by the rejection of their application for bail U/s 439 Cr.P.C. by the learned Addl. District & Sessions Judge, Umerkote by order dated 31.03.2022, the present BLAPL has been filed 5.
On perusal of the materials on record it is seen that the incident has happened out of sudden provocation without any premediation.

Considering the genesis of the offence and the age of the petitioner, this Court directs the petitioner to be released on bail on such terms to be fixed by the court in seisin over the matter. 7.
Accordingly, the BLAPL stands disposed of.
