This matter is taken up through Hybrid arrangement (video conferencing/physical mode).
This is an application for modification of the order dated 01.12.2022.
Learned counsel for the petitioner submitted that while granting interim protection as per order dated 01.12.2022, a condition, inter alia, has been imposed that the two local sureties who had taken the petitioner on interim bail as per order dated 29.09.2022, shall be the bailors for the petitioner. Learned counsel further submitted that the said local sureties are not willing to be the bailors for the petitioner and therefore, the petitioner may be permitted to furnish two fresh local solvent sureties.
Learned counsel for the State has no serious objection. Considering the submissions made by the learned counsel for the respective parties, the averments taken in the
// 2 // interim application, the order dated 01.12.2022 is modified to the extent that in the event the petitioner furnishes two fresh local solvent sureties as a condition for grant of interim bail as per order dated 01.12.2022, the same shall be accepted by the learned Court in seisin over the matter after due verification. With this modification, the rest part of the order dated 01.12.2022 remains unaltered.
The I.A. stands disposed of.
