Heard Mr. K.C. Sahoo, learned counsel for the petitioner and Mr. H.M. Dhal, learned Additional Government Advocate. 2.

According to Mr. Sahoo, the petitioner is aggrieved by the non-settlement of a piece of land in his favour though he is entitled to such benefit under law.

Mr. Dhal submits that since Encroachment Case bearing No.316 of 2021-22 is pending before the Tahasildar, Narsinghpur (opposite party No.4), the petitioner instead of rushing to this Court, should have filed an appropriate application before the said officer for settlement of land under the provisions of Odisha Prevention of Land Encroachment Act, 1972. In such background, Mr. Sahoo wants to withdraw this writ petition as he wants to approach the Tahasildar, Narsinghpur (opposite party No.4) for redressal of the grievances of the petitioner.
