ORDER

1. This petition has been filed challenging an order dated 20th March, 2009 passed by the learned Central Administrative Tribunal, Cuttack Bench, Cuttack (CAT) declining to proceed in in contempt petition, C.P. No. 50 of 2008, filed complaining about non-compliance by the Opposite Parties with the order dated 30th May, 2001 passed by the CAT in O.A. No. 26 of 2006.

2. While the Officers concerned were impleaded by name in C.P. No. 50 of 2008 but they have not been impleaded in the present petition. When asked about this, learned counsel for the Petitioner admits to the lapse but seeks leave to now amend the writ petition to rectify the error. Considering that this writ petition has been pending before this Court for nearly 12 years now, this Court is not inclined to grant the above prayer.

3. Moreover, even according to the learned counsel for the Petitioner, the Officers concerned may have superannuated by now. The Court sees no purpose in permitting the Petitioner to pursue the contempt proceeding at this stage.

4. This Court is not inclined to interfere with the impugned order of the CAT.

5. The writ petition is dismissed.
