Heard the learned for the petitioners and learned counsel for the State.

This is an application under section 438, Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Pottangi P.S. Case No. 21 of 2021 corresponding to G.R. Case No.222 of 2021 pending in the Court of learned S.D.J.M., Koraput for the commission of the alleged offences punishable under sections 341, 294, 323, 506, 307/34 of the Indian Penal Code and sections 25 and 27 of the Arms Act. Learned counsel for the State on instruction submitted that the injured S.Binod Kumar, who is the informant in the case has sustained four simple injuries.

// 2 // Considering the submissions made by the learned counsel for the petitioners that the ingredients of the offence under section 307 of the Indian Penal Code are not attracted and the fact that petitioners have been granted interim protection since 12.04.2021 and there is no material that they have misutilized their liberty and after hearing the learned counsel for the State, the interim order dated 12.04.2021 is made absolute.

The ABLAPL is accordingly disposed of.
