Mr. Pattnaik, learned advocate appears on behalf of petitioner and submits, his client availed credit facility from opposite party no.2 for purchasing a commercial vehicle. His client committed default and said opposite party took possession of the vehicle. His client wants to make good aggregate amount of default along with penalty, for the agreement to revive. Mr. Khatua, learned advocate appears on behalf of opposite party no.2 and submits, as per the agreement, on default the loan has been called up. There is due from petitioner Rs.19,16,429/-. 2.
Petitioner has liberty to approach opposite party no.2 with this order and his proposal. Said opposite party may consider petitioner's willingness to make good the default and pay
// 2 // penalty, for return of the vehicle on revival of the agreement. Petitioner is to approach within ten days from date. 3.
The writ petition is disposed of.
