This Contempt Petition has been filed challenging non-compliance of the order dated 22.11.2021 passed in W.P.(C ) No.35180 of 2021.

The aforesaid writ petition was disposed of on 22.11.2021 with a direction on opp. party no.1 to take a decision on the petitioner's claim as made in Annexure-4 to that writ petition. This Court while taking up the matter on the earlier occasion, it was intimated that W.P.( C) No.1003 of 2010 has been filed by the petitioner herein challenging the final order passed by the State Level Scrutiny Committee on 12.11.2009 and implementation of the same vide order dated 11.12.2009. When the matter was listed today, this Court after going through the pleadings made in W.P.(C ) No.1003 of 2010 and W.P.(C ) No.35180 of 2021 found that the petitioner while filing W.P.(C ) No.35180 of 2021 has not disclosed about the pendency of the matter

// 2 // in W.P.(C ) No.1003 of 2010. Since the order passed in W.P.(C) No.35810 of 2021 has been obtained by Committing fraud, this Court when proposed to issue notice to the petitioner, learned counsel for the petitioner prays for withdrawal of the contempt petition and filed a memo that effect.

In such view of the matter, the CONTC is dismissed as not pressed.
