Surrender certificate has been filed in Court today indicating that the petitioner has surrendered to custody on 13.07.2022, the same be kept on record.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 12.04.2022 in connection with Kuakhia P.S. Case No.359 of 2021 corresponding to C.T. Case No.2235 of 2021 pending in the Court of learned S.D.J.M., Jajpur for the alleged commission of offence under Sections 498A/304-B/302/34 of IPC read with Section 4 of DP Act. 5.
The petitioner is the sister-in-law of the deceased, who is said to have been killed by her in-laws. As per the prosecution case, the deceased was found to be burning in her bed room, which was bolted from inside. There is allegation of dowry torture prior to the occurrence. Charge sheet has been submitted against the husband and other in-laws under Section 304-B of IPC since the death occurred within one year of the marriage. The father-in-law, Gajendra Sahu, Mother-in-law, Kanchanabala Sahoo and sisters-
in-law, Sasmita Sahoo and Puspasri Sahoo have been released on bail as per orders passed by this Court in BLAPL No. 129 of 2022, BLAPL No.3381 of 2022 and BLAPL No. 3406 of 2022 respectively.

Considering the above facts and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail. 7.
BLAPL is accordingly disposed of.
