This matter is taken up through Hybrid Arrangement Order No.

(Virtual/Physical Mode).

Heard learned counsel for the Petitioner and learned counsel for the State.

The writ petition involves the following prayer: "It is therefore humbly prayed that this Hon'ble Court may graciously be pleased to admit the case, call for the records and after hearing both the parties pass the following reliefs: i) To quash the letter dtd.20.4.2018 under Annexure-1. ii) To direct the opposite parties to promote the petitioner to the rank of DSP from the date when juniors have got promotion.

iii) To direct the Opp. Parties to grant all financial, service and consequential benefits flowing from the date of promotion."

It is submitted by learned counsel for the Petitioner that due to adverse remark in the CCR, the case of the Petitioner was not considered for promotion by the Authority. Therefore, Petitioner filed a detailed representation before the Authority-Opposite Party No.1 on 12.8.2020. It

// 2 // is submitted that the same is pending before the said Authority as of now and no decision has been taken on the same till date. 5.

Learned counsel for the State on the other hand submits that since the matter is pending before the Opposite Party No.1, let the Opposite Party No.1 be directed to consider the matter in accordance with law within a stipulated period of time.

Considering the aforesaid submission and keeping in view limited nature of prayer, this Court disposes of the writ petition at the stage of admission with a direction to Opposite Party No.1 to consider the representation of the Petitioner dated 12.8.2020 (Annexure-2) within a period of two months from the date of production of certified copy of this order. In such event, Opposite Party No.1 shall consider the case of the Petitioner strictly in accordance with law and shall dispose of the same by passing a speaking and reasoned order. The decision so taken be communicated to the Petitioner within a period of two weeks thereafter. 7.

With the aforesaid observation, the writ petition stands disposed of.

Issue urgent certified copy as per rules.
