1. This matter is taken up through hybrid mode.
2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.
3. The Petitioner is in custody since 13th March, 2022 in connection with Plantsite P.S. Case No.509/2021 corresponding to G.R. Case No.2406/2021 pending in the court of learned S.D.J.M., Panposh, Rourkela for the alleged commission of the offence under Sections 408/420/468/471 of I.P.C.
4. It is alleged that the Petitioner while working as Junior Executive, Sales at Khimji Jewellary Shop, Rourkela and was
// 2 // in-charge of Dhanalaxmi Purchase Plan misappropriated huge amount of money deposited by the customers both online and off-line.
In course of investigation, the amount of misappropriation has been ascertained as Rs.5,39,000/-. Investigation appears to have progressed substantially. The Petitioner is a permanent resident of Khurdha District and presently residing at Rourkela.
5. Considering the above facts and taking into account the period of detention in custody, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the court below on each date of posting of the case without fail. Further, he shall furnish cash security of Rs.2,50,000/-(Rupees two lakhs fifty thousand) in the shape of short term fixed deposit in any Nationalised Bank being pledged to the court below. Such deposit shall be without prejudice to the rival claims.
6. The BLAPL is disposed of.
7. Urgent certified copy of this order be granted on proper application.
