Heard Mr. B. Pujari, learned counsel for the petitioner; Mr. B.P. Tripathy, learned Addl. Government Advocate; Mr. S.K. Nath, learned counsel for opposite party no.2; Mr. P. Chuli, learned counsel for opposite party no.3; and Mr. B. Samal, learned counsel for opposite party no.6.

The petitioner has filed this writ petition seeking to quash the order dated 24.03.2021 passed by opposite party no.2 under Annexure-3, and to issue direction to opposite parties no.1 and 2 to consider/evaluate the tender process, including the bid submitted by the petitioner company, and finalize the process of determination of the successful bidder for placing the work order. 4.

Mr. B. Pujari, learned counsel for the petitioner contended that making grievance, the petitioner has already approached the opposite party no.1 vide Annexure-5 dated 20.03.2021, which is still pending for consideration. It is contended that since the tender is for a period of one year and the same is going to be lapsed, in

the event, this writ petition is not considered before the tender period is over, it will cause prejudice to the petitioner and, as such, the writ petition will become infructuous. In reply thereto, learned counsel appearing for all the opposite parties contended that let this writ petition be disposed of directing opposite party no.1 to consider the grievance of the petitioner within a stipulated time. 5.

Having heard learned counsel for the parties and after going through the records, this writ petition stands disposed of directing opposite party no.1 to consider the representation of the petitioner as at Annexure-5 by passing a reasoned and speaking order as expeditiously as possible, preferably within a period of four weeks from the date of production of certified copy of this order. Issue urgent certified copy as per rules.
