This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is seeking pre-arrest bail in connection with C.T. Case No. 01 of 2017, arising out of Koksara P.S. Case No. 179 of 2017 pending in the Court of learned Special Judgecum- Addl. Sessions Judge, Dharamgarh for the alleged commission of offence punishable under Sections-20(b)(ii)(c) & 27(a) of N.D.P.S. Act.

It is seen from the note of the Registry that the petitioner had earlier moved this Court and by Order dtd.16.07.2018, this

Court had granted to the petitioner liberty to surrender and move for bail.

On perusal of the present ABLAPL, it is seen that there is no certificate to the said effect.

Taking into account, the nature of the allegation and conduct of the petitioner, this Court is not inclined to entertain this application under Section-438 Cr.P.C, the bail application of the petitioner stands rejected.

Accordingly, the ABLAPL stands dismissed.

8.

Urgent certified copy of this order be granted as per rules.
