I.A. No.1079 of 2023 1.

Heard learned counsel for the petitioner and learned counsel for the State.

This I.A. has been filed by the petitioner No.3 (Samir Mansingh) for extension of time to surrender. 3.

The present petitioner was petitioner No.3 (Samir Mansingh) in ABLAPL No.4413 of 2022 and by order dated 19.05.2022, this Court directed that on surrendering within three weeks hence and moving for bail, the petitioners therein to be released on bail.

It is submitted that though the petitioner Nos.1 & 2 have in the meanwhile been released on bail on surrendering, the petitioner No.3(Samir Mansingh) could not surrender within the time so fixed

and his inability to surrender was on account of reasons beyond his control and are bonafide.

Considering the submission made and the recitals in the I.A., further three weeks time is granted to the petitioner No.3 (Samir Mansingh) to surrender and on such surrendering, the petitioner No.3 (Samir Mansingh) shall be released on bail by the learned Court in seisin to fix the terms and conditions just deem and proper in terms of the order dated 19.05.2022. 6.

In the meanwhile, no coercive action be taken against the petitioner No.3 (Samir Mansingh) for a period of three weeks from today.

Accordingly, the I.A. stands disposed of.
