This matter is taken up through hybrid mode.

Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners are primarily aggrieved by the communication dated 14.08.2015 at Annexure-2 of Director personnel Office of the Engineer-in-Chief water Resources, Odisha, Bhubaneswar addressed to all Chief Engineers directing for recovery of employees share under the EPF Act.

It is submitted at the bar that the lis is covered by the order of this Court dated 08.08.2022 in W.P.(C)(OAC) No.1643/2016 in the case of Ganeswar Jena vs. State of Odisha and others. The order of this Court dated 08.08.2022 in the Case of Ganeswar Jena (Supra) is taken on record.

Keeping in view the submission of the learned counsel for the Parties the present Writ Petition is disposed of directing that in the event the petitioners file a representation before the Competent

Authority along with a copy of this order and the order passed by this Court in the case of Ganeswar Jena (Supra) the Authorities shall take a decision at the earliest preferably within a period of three months from the date of receipt of certified copy of this order. 6.

And while doing so, the decisions rendered by this Court and reported in 2016 (II) ILR-CUT 422 in the case of Executive Engineer, Right Canal Division No.II, Rengali Irrigation Prject vrs. Regional Provident Fund Commissioner and Others shall be taken into account.

The writ petition accordingly stands disposed of. 8.
