Heard submission of learned counsel for the Parties. 2.

Entering into objection raised by opposite parties, this Court going through the pleading this Court finds, Writ Petition involving a challenge to Annexure-5, the order in disposal of the Joint Commissioner of Consolidation Berhampur, Ganjam in revision at the instance of Private opposite parties. Perusal of cause title involving the revision, this Court finds the petitioners herein and the opposite parties No.4 & 5 herein have jointly contested the revision involved herein and the revision was finally decided against the petitioner and opposite party Nos.4 & 5 being respondents before the Revisional Authority. Writ Petition is filed undisputedly by some of the aggrieved parties.

For the joint contest of petitioner and opposite parties No.4 & 5 in the revision, for the opinion of this Court, Writ Petition at the instance of part of opposite parties files therein at this stage is not

// 2 // entertainable as it may be leading to different orders by different Courts but involving common cause of action. In the circumstance this Court finds the Writ Petition is not entertinable at the instance of the present petitioner which is dismissed accordingly. (Biswanath Rath) Judge S.P. Dash
