Heard learned counsel for the parties.

The petitioners are seeking pre-arrest bail in connection with Tirtol P.S. Case No. 74 of 2022 corresponding to G.R. Case No. 72 of 2022, pending on the file of the learned JMFC, Tirtol for commission of offence under Sections 341/323/294/307/34 of the I.P.C.

Learned counsel for the petitioners does not want to press this application for anticipatory bail, so far as Petitioner No.2 is concerned.

Accordingly, the anticipatory bail application in respect Petitioner No.2- Kumar Swain is dismissed as not pressed. 6.

So far petitioner No.1 is concerned, taking into account that the petitioner is a lady and in terms of the Proviso under Section 437(1) Cr.P.C., this Court directs that on surrendering

within three weeks hence and moving for bail, the petitioner No.1 shall be released on bail by the learned court in seisin over the matter on such terms and conditions as deemed just and proper. 10.

Accordingly, the ABLAPL stands disposed of.
