The dispute involves Section 23(A) of the O.L.R. Act, 1960 and an Appeal thereafter at the instance of the present Petitioners. For the concurrent finding of facts by both Forums, the Petitioners failing in establishing that they belong to Scheduled Castes and there is requirement of restoration of possession, this Court finds no scope to interfere with the concurrent finding of facts by both Forums. 3.

The Writ Petition thus stands dismissed. Interim order dated 16.5.2005 passed in Misc. Case No.6218 of 2005 stands vacated. (Biswanath Rath) Judge M.K.Rout
