None appears for the petitioner when the matter is called. 3.

The lis inter alia relates to promotion of the petitioner to the next higher post of Asst. Manager and consequential fixation of salary.

Ms. P. Rath, learned counsel for the IDCOL-Opposite Party Nos.2 and 3 submits that with efflux of time the matter become infructuous.

Be that as it may, since there is no appearance on behalf of the petitioner the Writ Petition is dismissed for non-prosecution with liberty to the petitioner to file afresh in the event, if cause of action survives.
