Instant I.A. is filed for modification of the order dated 13th September, 2022 passed by this Court in CRLMC No. 1053 of 2022 to the extent prayed for.

Learned counsel for the petitioner submits that the CRLMC was inadvertently disposed of as dismissed which is required to be modified on the ground that a liberty is granted to the petitioner for seeking discharge during enquiry. In other words, it is submitted that the CRLMC should have been disposed of without being dismissed and to the extent that the order is needed to be modified. 3.

For the reason stated, the I.A. stands allowed.

Consequently, the order dated 13th September, 2022 passed in CRLMC No. 1053 of 2022 should be read as the CRLMC to have been disposed of instead of being dismissed. However, the rest part of the order shall remain unaltered.
