This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Spl. G.R. Case No.153 of 2021, on the files of learned Additional Sessions Judge-cumSpecial Court under POCSO Act, Cuttack, arising out of Banki P.S. Case No.272 of 2021, under Sections 363/366/376 2(n) of IPC read with Section 6 of POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Court under POCSO Act, Cuttack, by order dated 12.04.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the rejection order.

Learned counsel for the petitioner places on record the 164 Cr.P.C. statement of the victim. Copy of the same be taken on record.

Taking into account the tenor of such statement and the period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
