This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioners are seeking pre-arrest bail in connection with Spl. (POCSO) Case No.23 of 2022, arising out of Dhamnagar P.S. Case No.109 of 2022 pending in the Court of learned Special Judge, Bhadrak for commission of offence punishable under Sections 363/366/376/506/34 of the IPC.

Taking note of the submissions made by the learned counsel for the petitioner that the victim in the meanwhile has been rescued and has joined her mother and placing reliance on the recitals in the FIR which prima facie show that the allegation
against the present petitioner is that they facilitated the petitioner, the principal accused in committing offence, this Court directs that on surrendering within three weeks hence, the petitioners shall be released on bail by the learned Court in seisin over the matter on such terms as deemed just and proper.

Accordingly, the ABLAPL stands disposed of.
