This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel Mr. Siddharth Pr. Mishra has appeared on behalf of the informant. Registry is requested to trace the Vakalatnama and tag with the file and reflect his name both in the cause list as well as on the file.

The petitioner is an accused in T.R. Case No.39 of 2021, on the files of learned Additional District & Sessions Judge-cumP.O. Spl. Court POCSO Act, Rayagada arising out of Gunupur P.S. Case No.63 of 2021, under Sections 363/366-A/34 charge sheeted under Section 363/366/344/376(2)(n)/376(3) of IPC read with Section 4(2)/6 of the POCSO Act and is in custody since 07.06.2021.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge-cum-P.O. Spl. Court POCSO Act, Rayagada, by order dated 25.03.2022 in the aforementioned case, the present BLAPL has been filed.

Keeping in view that the trial has already commenced and taking into account the statement of the learned counsel for the informant that four witnesses have been examined, this Court is not inclined to entertain this bail application at this stage. 7.

Since the petitioner is in custody since 07.06.2021 learned Court in seisin over the matter is called upon to conclude the trial within a period of two month from the date of production of the certified copy of this order and it shall be open to the petitioner to renew his prayer in the event the trial is not concluded within the time stipulated.

Accordingly, the BLAPL stands disposed of.
