This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in T.R. Case No.15 of 2022, on the files of learned Additional Sessions Judge-cum-Special Judge, Jeypore, arising out of Narayanpatna P.S. Case No.129 of 2021, under Sections 376(2)(n)/417/323/294/506/363/366 of IPC and Section 75 of J.J. Act, read with Section 4 and 6 of the POCSO Act and is in custody since 26.12.2021.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Jeypore, by order dated 22.03.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the filing of charge sheet on 26.12.2021 and the conduct of the accused who did not misuse the

liberty granted by this Court and the tenor 164 Cr.P.C. statement, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 6.

Accordingly, the BLAPL stands disposed of.
