This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 06.12.2021 in connection with Jeypore Sadar P.S. Case No.325 of 2021 corresponding to T.R. Case No.104 of 2021 pending in the court of learned Addl. Sessions Judge, Koraput-Jeypore for the alleged commission of offence under Sections 20(ii)(b)(c) & 29 of the NDPS Act.

As it appears, no contraband was seized from the possession of the petitioner but he was implicated on the basis of the statement of the co-accused, who claimed to have collected the contraband from the petitioner.

It is submitted by learned counsel for the petitioner that another co-accused person on similar footing with the present petitioner has already been released on bail by this Court by order

// 2 // dated 28.03.2022 in BLAPL No.2068 of 2022.

Having regard to the above and the period of detention in custody. I am inclined to allow prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail. 7.

The BLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
