This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R Case No.122 of 2022, on the files of S.D.J.M. Nayagarh, arising out of Nuagaon P.S. Case No.40 of 2022, under Sections 376/323/342 of IPC and is in custody since 29.02.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Nayagarh, by order dated 13.04.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that charge-sheet has been filed in the case at hand on 24.04.2022 there is further continuance of the petitioner is not warranted. 6.
Perused the 164 Cr.P.C. statement of the victim.

Considering the tenor thereof and taking into account filing of the charge sheet and that the petitioner is in custody since 29.02.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
