This matter is taken up through virtual/physical mode. 2.
The Petitioner, a charitable trust has laid challenge to the sale notice dated 4th April, 2022 (Annexure-1), whereby the auction sale of the secured assets is stated to be fixed on 25th April, 2022 by the Authorized Officer of the Odisha Gramya Bank, Khurda to recover the outstanding liability of Rs.2,71, 28, 497/- due as on 4th April, 2022. 3.
Mr. Tuna Sahu, counsel appearing for the Bank submits that the auction fixed for 25th April, 2022 has failed for lack of any intending bidders. He further submits that on proposal furnished by the Petitioner on 25th April, 2022, a "compromise settlement" dated 30th April, 2022 has been arrived at, whereby the Petitioner is required to pay up a sum of Rs.1 crore 51 lakhs towards full and final settlement within 90 days of the date of sanction, i.e. by end of July, 2022.

In view of the above, counsel for the Petitioner concedes that the present writ petition has become infructuous. 5.
Accordingly, this writ petition is dismissed as infructuous.
