1. The impugned order of the learned Single Judge is merely one of remanding the matter to the Officer-on-Special Duty (L.R.), Paralakhemundi for a fresh decision in accordance with law. There has been no stay of the impugned order for over five years now. Assuming that the matter is still pending on remand before the aforementioned authority, it will be open to the Appellant to urge all the pleas available to him in accordance with law before the said authority.

2. The appeal is accordingly disposed of.
