Heard learned counsel for the Parties.

Mr.Joshi, learned counsel for the Petitioner even though alleged that copy of the order of this Court dated 24.2.2021 passed in W.P.(C) No.3346/2021 has been served on the Tahasildar, O.P.4 therein, the Tahasildar in disrespect of the same has demolished a part portion of the disputed property, but however, this Court finds, there is no proof of such service of copy of this Court's order. There is also no naming of the Contemnor instead there has been incorporation of the names of some persons, who are not desired to work out this Court's order.

It is at this stage of the matter, Mr.Joshi, learned counsel for the Petitioner seeks withdrawal of the Contempt Petition with liberty to move a duly constituted Contempt Petition. 4.

In the circumstance, the Contempt Petition stands permitted to be withdrawn but however with the liberty as prayed for. (Biswanath Rath) Judge M.K.Rout
