Heard the learned counsel for the Parties.

Mr.Mohanty, learned Senior Counsel brings to the notice of the Court that parties attempted to come by way of intervenor, many of them died in the meantime. In the circumstance, there is no issue in continuing with such application. Further in the circumstance and for the development indicated hereinabove, Petitioners seek withdrawal of the Writ Petition with liberty. In the event, there is contingency still surviving to bring appropriate application for consideration of the trial court may be moved. 3.
This Court expresses no opinion on the admissibility of any further application which will be decided on its own prospective. The Writ Petition stands withdrawn with liberty as prayed for with the observation indicated hereinabove. Hearing of suit expedited. Interim order stands vacated. (Biswanath Rath) Judge Swarna
