Petitioner in this CMP seeks to assail the order dated 8th November, 2013 (Annexure-1) passed by learned Civil Judge (Senior Division), Bhubaneswar in CS No.780 of 2006, whereby an application filed by the Petitioner under Order 1 Rule 10 CPC has been rejected.

3.1 From the order sheets, it appears that after issuance of notice, the CMP is being adjourned either for taking steps or for taking instruction from the counsel appearing before learned trial Court. Today, none appears for the parties to pursue the matter. Thus, it appears that parties have lost interest to pursue the CMP.
