This CMP has been filed assailing the order dated 6th December, 2013 (Annexure-7) passed by learned Civil Judge (Senior Division), Bhubaneswar in I.A. No.804 of 2013 (arising out of C.S. No.1094 of 2008), whereby entertaining an application under Section 151 C.P.C., parties to the suit are directed to maintain status quo over the suit land/Schedule A property i.e. Plot No.1433 to an extent of Ac.0.78 decimals with a further direction not to raise any structure thereof and change the nature and character of the suit land.

On perusal of the order sheet, it appears that the impugned order under Annexure-7 has been stayed by this Court vide interim order dated 3rd March, 2014 passed in Misc. Case No.147 of 2014. It further appears that the suit is of the year, 2008. Probably, in view of the interim order passed, the Petitioner is not interested to pursue the CMP. 5.

Accordingly, this CMP is dismissed for non-prosecution.
