The matter is taken up by hybrid arrangement (virtual/physical) mode.

This is the successive journey of the Petitioner in filing this application under Section-438 of the Cr.P.C. for his grant of bail in the event of his arrest in connection with Bandhugaon P.S. Case No. 56 of 2017 corresponding to G.R. Case No. 205 of 2017 on the file of learned J.M.F.C., Laxmipur for alleged commission of offence under section 364/302/201/34 of the IPC, for his release on bail in the above mentioned case.

Heard learned Counsel for the Petitioner and learned Counsel for the State.

Considering the submissions made and on going through the materials as placed; further keeping in view the earlier order passed by this Court in ABLAPL No.10750 of 2018, finding no changing circumstances, I am not inclined to reconsider the prayer for grant of anticipatory bail to the Petitioner. It is however observed that if the Petitioner would surrender before the Court is seisin of the case and moves for his release of bail, the same shall be considered on its own merit; further taking into account all such developments which have taken place in the meantime in their proper perspective and disposed of in accordance with law. 5.
The ABLAPL is accordingly disposed of.
Issue urgent certified copy as per rules.
