3. The petitioner is in custody in connection with Orkel P.S. Case No. 47 of 2018 corresponding to T.R. Case No.38 of 2018 pending in the court of the learned Additional Sessions Judge-cum-Special Judge, Malkangiri, registered for the alleged commission of offence under Section20(b)(ii)(C) of the NDPS Act, has filed this application under Section 439 of Cr.P.C. for their release on bail.

4. Learned counsel for the petitioner submits that since the petitioner has been acquitted in the aforesaid case, the matter has become infructuous.
