Referring the order-sheet at Annexure-4 and also the impugned order, Mr. Behera, learned counsel for the Petitioners submitted that there was in fact several adjournments of the matter involved on Covid-19 ground and even though the Opposite Parties therein prepared their response, it could not be filed for the prevailing situation there. However the trial court has mistakenly disposed of the matter under Annexure-3. Mr. Behera, learned counsel for the Petitioners submits that there was no argument on behalf of this Opposite Parties and it is not known how the trial court has recorded appearance of such parties. In the process Mr. Behera, learned counsel for the Petitioners requests this Court for withdrawing the writ petition with liberty to the Petitioners to approach the trial court for correction of the order dated 9.12.2021 and file objection to such matter.

The Civil Miscellaneous Petition stands disposed of as withdrawn but with liberty as prayed for.
