Heard learned counsel for the parties.

The petitioner is seeking pre-arrest bail in connection with Balichandrapur P.S. Case No. 417 of 2021, pending on the file of the learned JMFC, Chandikhole for commission of offence under Section 52(a) of Orissa Excise Act, 2008 4.

Taking into account the submission of the learned counsel for the petitioner that co-accused has already been released on bail, this Court directs that on surrendering within three weeks hence and moving for bail, the petitioner shall be released on bail by the

learned court in seisin over the matter on such terms and conditions as deemed just and proper.

Accordingly, the ABLAPL is disposed of.
