1. Heard Mr. P.K. Sahoo, learned counsel for the Appellant.

2. None appears on behalf of the Respondent No.1 in spite of valid service of notice. But Respondent No.1, the claimant, has sent a letter to this Court stating that he has already received the entire award amount from the court of the learned Commissioner before receipt of notice in the present appeal.

3. The present appeal is by the Executive Engineer, i.e. the employer and the deceased while working as an I.T.I. apprentice died on the date of accident i.e.26.8.2008 due to electrocution.

4. Learned Commissioner for Employees Compensation, Berhampur, Ganjam in W.C. Case No.17/2009 has directed for payment of compensation to the tune of Rs.2,62,987/- to the claimants on account of death of the deceased in course of his employment.

5. The Appellant does not dispute the fact of employment of the deceased under him on the date of accident nor the monthly remuneration to the tune of Rs.1440/- of the deceased. The death of the deceased while undertaking the work of electric transformer is also not disputed. As such no merit is seen in the appeal to be entertained.

6. In the result, the appeal is dismissed.
