Learned counsel for the Petitioner alleges that even after filing of the appeal, the appeal is not being taken up and the Petitioner is suffering on account of the order of demolition and eviction. It is submitted by the learned counsel for Petitioner that the Petitioner has already approached this Court earlier and on leave from this Court, though the Petitioner filed an application for interim protection in the appeal, this petition is not being taken up. 2.
Considering the submission made by the learned counsel for Petitioner, this Court without entering into the reason of not taking up the appeal, however observes, the Petitioner deserves to be protected for the pendency of the appeal as well as the application for interim protection at least till the application for interim protection is considered and decided.
