Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 16.10.2021 in connection with Plantsite P.S. Case No. 389 of 2021 corresponding to S.T. Case No. 22 of 2022 pending in the court of learned Addl. Sessions Judge, Rourkela for the alleged commission of offence under Section 302 of IPC.

Considering the nature of accusations and the availability of materials prima facie in support thereof, I am not inclined to allow the prayer, which is therefore, rejected. It is open to the petitioner to renew his prayer after examination of Chakradhar Biswal during trial. 5.

The BLAPL is accordingly rejected.
