This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioner is seeking pre-arrest bail in connection with Capital P.S. Case No. 170 of 2022, corresponding to C.T. Case No. 1695 of 2022 pending on the file of the learned SDJM, Bhubaneswar, for commission of offence under Sections 272/ 273/ 294/506/553/34 of the I.P.C. and sec.52(a) of the Orissa Excise Act.

Taking into account the submissions of the learned counsel for the petitioner that principal accused has already been released on bail by the court below, this Court directs that on surrendering

within three weeks hence and moving for bail, the petitioner shall be released on bail by the learned court in seisin over the matter on such terms and conditions as deemed just and proper.

Accordingly, the ABLAPL is disposed of.

Urgent certified copy of this order be granted as per rule.
