Mr. Mohapatra, learned advocate appears on behalf of petitioner and submits, his client stood guarantee for private opposite party no.3 availing vehicle loan from opposite party no.2 (Financer). His client was served with notice dated 9th February, 2022 regarding opposite party no.2 calling upon, inter alia, his client to pay Rs.35,92,198.06 within four days, failing which the financier would proceed. He submits, the truck stands hypothecated but the financier is not proceeding against the borrower.

Mr. Panigrhi, learned advocate, appears on behalf of the finance company and submits, he does not have instruction as to whether the truck has been seized.
