This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with S.T. Case No. 60 of 2020 arising out of Sarat P.S. Case No. 49 of 2019, pending on the file of the learned District & Sessions Judge, Mayurbhanj, Baripada for the alleged commission of offence under Sections-302 of the IPC.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Sessions Judge, Mayurbhanj, Baripada by Order dtd. 18.03.2021 in S.T. No. 60 of 2020, the present BLAPL has been filed.

Heard learned counsel for the petitioner and learned Counsel for the State.

The report has been submitted by the learned Sessions Judge, Mayurbhanj, Baripada indicating that the sole eyewitness- Markanda Purty has already been examined and the

deposition is on record. The child witness has been examined and implicated the petitioner.

Taking note of the same, this Court is not inclined to entertain this application. The petitioner is in custody since 23.12.2019, the learned Court in seisin over the matter to conclude the trial within a period of four months from the date of receipt/production of the certified copy of this order. 7.

It shall be open to the petitioner to renew his prayer, in the event, the trial is not concluded within the time stipulated and the delay is not attributable to him.

The Bail Application thus stands disposed of. 9.
