Heard learned counsel for the petitioner and learned counsel for the State.

Instant petition under Section 482 Cr.P.C. is filed by the petitioner for a direction to the learned court below in G.R. Case No. 702 of 2010 to take action against opposite party No.2 and to ensure expeditious disposal of the case.

Learned counsel for the petitioner submits that this Court in CRLMP No. 1133 of 2019 by order dated 24th October, 2019 while disposing of the matter issued a direction to the learned SDJM, Kendrapara to make endeavour to dispose of G.R. Case No. 702 of 2010 by the end of 2020 in accordance with law but then the said order was flouted by the court below which is clearly evident from order dated 2nd December, 2020 as the case was posted to a date of 2022.

A limited prayer is made by the learned counsel for the petitioner which is to be effect that a peremptory direction should be made to the learned SDJM, Kendrapara to ensure expeditious trial of G.R. Case No. 702 of 2010.

Considering the above submission and the fact that this Court had already fixed a target to complete the trial and ensure disposal of the aforesaid case by the end of 2020, but as it appears inadvertently the court below fixed it to a date beyond 2020, the Court is of the view that the trial has to be expedited at any cost having regard to the fact that the same is more than a decade old. 6.

Accordingly, it is ordered.

In the result, the CRLMC stands disposed of with a direction to the learned SDJM, Kendrapara to expedite the disposal of G.R. Case No. 702 of 2010 preferably within a period of six months peremptorily and in any case not later than March, 2023. (R.K. Pattanaik) Judge
