This matter is taken up through video conferencing mode. 2.

Heard Mr. S. Rath, learned counsel for the petitioner and Mr. D.K. Mohanty, learned Additional Standing Counsel. 3.

In this case, prayer has been made by the petitioner-wife for execution of non-bailable warrant of arrest against her husband (opposite party No.4) on account of non-payment of maintenance in connection with CRP Execution No.06 of 2015 4.

During course of hearing Mr. Rath submits that liberty may be granted to the petitioner to approach the learned Judge, Family Court, Kendrapara by filing an appropriate application under Sections 82 & 83 of the Code of Criminal Procedure, 1973.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to move an application before the learned Judge, Family Court, Kendrapara under appropriate provisions of the Code of Criminal Procedure, 1973 within a

// 2 // period of two weeks from today. In the event, such application is filed, the learned Judge, Family Court, Kendrapara is directed to proceed with the same in accordance with law, if there is no other impediment.

The CRLMP is accordingly disposed of.
